AccessAthletes Privacy Policy

This Privacy Policy is effective as of March 25, 2008.

AccessAthletes.com is a social and professional platform for athletes and the sports community. AccessAthletes.com allows "Members" (which means you have registered with AccessAthletes.com) to set up unique personal profiles that are part of an interactive network of other Member profiles. The AccessAthletes.com service and network (collectively "AccessAthletes.com" or "the Service") are owned and operated by Access Athletes, LLC (collectively, "us", "we" or "the Company").  By using the www.AccessAthletes.com web site (the "Web site") you signify that you have read, understand and agree to be bound by this Privacy Policy ("Privacy Policy") whether you are a "Visitor" (which means that you simply browse the AccessAthletes.com Web site) or a Member.

The AccessAthletes.com network allows AccessAthletes.com Members to view each others' profiles, add new Members and communicate with existing Members of your Entourage, share photos, post comments and recent news, and describe their general background and interests. To enhance our Members' experience, we request and display some personal information to other Members and Visitors, which allows our Members to identify each other and expand their network of Members. We understand that Members may not want everyone in the world to have the information you share on AccessAthletes.com, which is why AccessAthletes.com Members can change their profile information at any time and can control how other Members and the Service communicates with them by personalizing the privacy settings on their profile (the link located under the profile picture).

AccessAthletes.com's Privacy Policy (and any revisions thereto) is designed to help you understand how we collect and use the personal information you decide to share, and help you make informed decisions when using the AccessAthletes.com Web site. This Privacy Policy shall govern all information collected from or posted at AccessAthletes.com, and the use of the personal information you decide to share. We reserve the right, at our sole discretion, to change, modify, add or delete portions this Privacy Policy at any time without further notice. If we do this, we will post the changes to this Privacy Policy on the Web site and will indicate at the top of the page the Privacy Policy's effective date. Your continued use of the Service or the Web site after any such change constitutes your acceptance of the new Privacy Policy. If you do not agree to be bound by these or any revisions thereto, please do not use or access the Service or the Web site. It is your responsibility to regularly review this Privacy Policy.

INFORMATION COLLECTION AND USE BY ACCESSATHLETES.COM
AccessAthletes.com collects Member submitted information such as name, email address, phone number, work information, and birthdates to authenticate Members and to send notifications to those Members relating to the AccessAthletes.com Service.

AccessAthletes.com also logs non-personally-identifiable information including IP address, profile information, aggregate Member data, and browser type, from Members and Visitors to the Web site. This data is used to manage the Web site, track usage and improve the Web site services. AccessAthletes.com also collects other profile data including but not limited to: general background information, sports and personal interests, gender, school, geography, education, and occupation in order to assist Members in finding and communicating with each other. This non-personally-identifiable information may be shared with third parties to provide more relevant services and advertisements to Members. Member IP addresses are recorded for security and monitoring purposes.

Member profile information including Members' pictures and nicknames are displayed to people in order to facilitate Member interaction in the AccessAthletes.com social networking community. Email addresses are used for the purposes of inviting new friends to join AccessAthletes.com, to add users to Members' Entourage networks, and to send notifications related to the Service. Members within a personal network communicate on AccessAthletes.com with each other through the AccessAthletes.com Service, without disclosing their email addresses. Members can also hide contact information on their profiles from all Members on the site, including Members of their Entourage.  To facilitate searching and finding new contacts on the Service, AccessAthletes.com allows Members to search for other Members using first and last name, geographical location, member type (agent, athlete, media, or fan), and by any other word that appears on a Member's profile. We may also use a Member's email address to send updates, a newsletter or news regarding the Service.

From time to time, AccessAthletes.com or a partner may sponsor a promotion, sweepstakes or contest on AccessAthletes.com. Members may be asked to provide personal information including name, email address or home address or to answer questions in order to participate.

INVITATIONS AND OTHER COMMUNICATIONS TO NON-MEMBERS
AccessAthletes.com Members can invite friends to join the service by sending invitation emails via our automated invitation system. AccessAthletes.com stores the email addresses that Members provide so that the respondents may be added to the Entourage list of the Member sending the invitations, and also to send reminders of the invitations. AccessAthletes.com does not sell these email addresses or use them to send any other communication besides invitations and invitation reminders. Recipients of invitations from AccessAthletes.com may contact AccessAthletes.com to request the removal of their information from our database.

CHILDREN UNDER THE AGE OF 13
AccessAthletes.com does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information to or on AccessAthletes.com. In the event that we learn that we have collected personal information from a child under age 13 we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at Info@AccessAthletes.com.

SHARING AND DISCLOSURE OF INFORMATION WITH THIRD PARTIES
We do not provide contact information to third party marketers without your permission. We share your information with third parties only in limited circumstances where we believe such sharing is: 1) Reasonably necessary to offer the Service; 2) Legally required; or, 3) Permitted by you. For example:

  1. We may provide information to service providers to help us bring you the services we offer. Specifically, we may use third parties to facilitate our business, such as to host the Service at a co-location facility for servers, to send out email updates about AccessAthletes.com, to remove repetitive information from our Member lists, to process payments for products or services, or to provide search results or links (including sponsored links). In connection with these offerings and business operations, our service providers may have access to your personal information for use for a limited time in connection with these business activities. Where we utilize third parties for the processing of any personal information, we implement reasonable contractual and technical protections limiting the use of that information to the AccessAthletes.com specified purposes.
  2. We may be required to disclose Member information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. We do not reveal information until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, we may share account or other information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the Service or using the AccessAthletes.com name, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies.
  3. We let you choose to share information with marketers or electronic commerce providers through sponsored groups or other on-site offers.
  4. We may offer stores or provide services jointly with other companies on AccessAthletes.com. You can tell when another company is involved in any store or service provided on AccessAthletes.com, and we may share Member information with that company in connection with your use of that store or service.
  5. If the ownership of all or substantially all of the AccessAthletes.com business, or individual business units owned by Access Athletes, LLC, were to change, your Member information may be transferred to the new owner so the Service can continue operations. In any such transfer of information, your Member information would remain subject to the promises made in any pre-existing Privacy Policy.

MESSAGE & FEEDBACK FORUMS
Please be aware that whenever you voluntarily post public information to Message and Feedback Forums, or any other Public Forums, that information can be accessed by any Member of the Web Site.

USE OF COOKIES
AccessAthletes.com uses "cookies" to help create a better and, for our registered Members, a more personalized experience. A cookie is a piece of data stored on the user's computers tied to information about the user. Cookies can only track information provided to the site itself. They are not "spyware" but only store information you have provided in personally identifiable form, or some of your AccessAthletes.com activities. This information includes your Member name and password, to avoid your having to retype it every time you return to the Web site. Cookie information is stored on your computer, not ours. Your browser and other security applications can be set to prompt you when a website is setting a cookie or to reject all cookies. Unless you accept our cookies, you will not be able to use our website effectively, and many site sections and applications will not function properly or at all. Please note that AccessAthletes.com allows third party advertisers that are presenting advertisements on some of our pages to set and access their cookies on your computer. Advertisers' use of cookies is subject to their own privacy policies, not the AccessAthletes.com Privacy Policy.

THIRD PARTY ADVERTISING
Advertisements that appear on AccessAthletes.com are sometimes delivered (or "served") directly to Members by third party advertisers. They automatically receive your IP address when this happens. These third party advertisers may also download cookies to your computer, or use other technologies such as JavaScript and "web beacons" (also known as "1x1 gifs") to measure the effectiveness of their ads and to personalize advertising content. Doing this allows the advertising network to recognize your computer each time they send you an advertisement in order to measure the effectiveness of their ads and to personalize advertising content. In this way, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. AccessAthletes.com does not have access to or control of the cookies that may be placed by the third party advertisers. Third party advertisers have no access to your contact information stored on AccessAthletes.com unless you choose to share it with them. This privacy policy covers the use of cookies by AccessAthletes.com and does not cover the use of cookies or other tracking technologies by any of its advertisers.

SECURITY
AccessAthletes.com Member accounts are secured by Member-created passwords. Although no communications over the Internet are 100% secure, AccessAthletes.com takes precautions to insure that Member account information is kept private. We use reasonable measures to protect Member information that is stored within our database, and we restrict access to Member information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. Please note that we cannot guarantee the security of Member account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of Member information at any time. CONTROL OF YOUR PASSWORD
You are responsible for all actions taken with your login information and password. Therefore we do not recommend that you disclose your AccessAthletes.com password or login information to any third parties. If you choose to share this information with third parties, you are responsible for all actions taken with your login information and password and therefore should review each third party's privacy policy. If you lose control of your password, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password.

YOUR USE OF OTHER MEMBERS' INFORMATION
Our services also include access to message forums and other modes of communication. As a Member you have access to other Members' profiles, and you might gain access to other contact information of Members through the use of message boards and other modes of communication. By accepting this Privacy Policy, you agree that, with respect to other Members' personally identifiable information that you obtain through your use of the Web site and/or the Service, you may only use such information for: (a) AccessAthletes.com-related communications that are not unsolicited commercial messages, and (b) any other purpose that such Member expressly agrees to after adequate disclosure of the purpose(s). In all cases, you must give Members an opportunity to remove themselves from your database and a chance to review what information you have collected about them. In addition, under no circumstances, except as defined in this Section, can you disclose personally identifiable information about another Member to any third party without our consent and the consent of such other Member after adequate disclosure. AccessAthletes.com and our Members do not tolerate spam. Therefore, without limiting the foregoing, you are not licensed to add AccessAthletes.com Members to your mail list (email or physical mail) without their express written consent after adequate disclosure. To report spam from other Members, please contact us at Info@AccessAthletes.com or you can click on the "report a foul to the ref" link under the profile picture.

LINKS
AccessAthletes.com contains links to other web sites. We of course are not responsible for the privacy policies and/or practices on other web sites. When linking to another web site we encourage our Members to read the privacy policy stated on each and every web site. This Privacy Policy only governs information collected on AccessAthletes.com.

CHANGING OR UPDATING INFORMATION
AccessAthletes.com Members may modify or remove some of their profile information at any time by logging into their account. Information will be updated immediately. Individuals who wish to deactivate their AccessAthletes.com account may do so by logging on to their account and accessing features such as Edit Profile Information and Quick Stats. Removed information may persist in backup copies for a reasonable period of time but will not be generally available to members of AccessAthletes.com.

Where you make use of the communication features of the service to share information with other individuals on AccessAthletes.com, however, (e.g., posting on someone else's personal page by way of the Sportspad function) you generally cannot remove such communications.

CHANGES IN OUR PRIVACY POLICY
From time to time we may make changes to our Privacy Policy. If we make changes, we will post them on the Web site to make Members and Visitors aware of what the changes are so Members and Visitors will always be aware of what information we collect, how we use it, and when we may disclose it. Members and Visitors are bound by any minor changes to the policy when she or he uses the Web site after those changes have been posted. If, however, we are going to use Members' personally identifiable information in a manner materially different from that stated at the time of collection we will notify by posting a notice on our Web site for 30 days.
